Realizing employer’s recruitment process to protect domestic labor’s benefits

Since Nov. 1st, 2006 for those employers who do not follow relevant rules in recruiting domestic labor, public employment service institutes affiliated to the Council of Labor Affairs will not issue proofs of human resources registrations, in order to ensure benefits of domestic labor. 

In accordance with laws, employers who intend to employ foreign labor shall register for reasonable working contents and qualifications in public employment service institutes where the working place is located, and may be approved for foreign labor employment when unable to recruit enough domestic labors after posting advertisements in newspaper for 3 days. In order to realize the employer’s recruitment process for domestic labor, the Council of Labor Affairs has stipulated that employers requiring tests during recruitments shall register in the public employee service institutes and simultaneously provide test items and qualifications for future reference, which shall also be declared if recruitment is posted as advertisements in newspapers to prevent employer’s from deliberately and temporarily changing test contents to frustrate domestic employees. The interviewing or testing spots shall be selected in public employee service centers or the designated places for foreign labors, and arrangements shall be made for picking up services if inaccessible through public transportation modes. To prevent single items for recruitments to impact on opportunities of domestic labor, labor recruitment registrations for significant construction projects shall be confirmed by title of the agency or authorized construction supervisors in terms of working items and labor demands. Employers who do not abide by the above-mentioned rules will not be issued with procurement proofs by public employment service institutes.
