Public affair institutions should contribute to the pension fund under the new pension scheme for temporary workers

According to the instructions of the Executive Yuan and the Council of Labor Affairs, public affair institutions should contribute to pensions of temporary workers who are employed without being subject to the Civil Servant Act, according to the regulation of voluntary contribution mentioned in Article 7 of Chapter 2 of the Labor Pension Act. The expenses needed should be applied for through budget planning by institutions which provide employment. 

The Council of Labor Affair states that ‘temporary workers who are employed without being subject to the Civil Servant Act’ apply to temporary workers employed by public affair institutions who are not civil servants (employees who are hired under the Civil Servant Act), contract workers (employees who are hired under the Contract Worker Act and the Executive Yuan’s Affiliated Institutions Employment Act), nor technicians, drivers or janitors who are subject to the Labor Standard Act from the 1st of July 1998 which was announced by the Council of Labor Affairs. As for workers employed through employment promoting measures such as ‘Public Employment Act’, ‘Diverse Employment Extension Act’ and ‘Temporary Employment Aid’, their relationship with the employer is not a conventional relationship based on employment, but a relationship based on public aid. Therefore they are not subject to the Labor Standard Act; and the Labor Pension Act does not apply to them. Employing institutions should not contribute to their pension under the new pension scheme. 

All public affair institutions should start the process of voluntarily contributing to the pension of temporary workers who are not subject to the employment Acts mentioned above from the 1st of January, 2006. On the 5th of January, 2006, the Council of Labor Affairs have instructed all public affair institutions to begin the process. According to the statement, Number 0940061782 under Labor 4, from the Council of Labor Affairs, when the institutions contribute to the pension of the mentioned temporary workers, temporary workers do not need to contribute in advance. The ‘Labor Pension Contribution Application Form’ should be filled out and sent off according to the instructions. The application form can be attained from various branch offices of Council of Labor Affairs or downloaded from the Council’s website (http://www.bli.gov.tw).
