‘Review Guidelines for the Life Management Planning Document Prepared by The First-time or Experienced .....

Associated with revised articles of Management and Approval Regulations for the Employment of Foreign Nationals promulgated on Oct. 3rd, 2006, the Council adapts the ‘Review Guidelines for the Life Management Planning Document Prepared by The First-time or Experienced Employers for Recruiting Second-type Foreigners’ in order to advocate that employers follow the Life Management Planning document and enhance management and supervision of local governments for securing working rights of foreigners in Taiwan, declared for implementation on Nov. 11th, 2006. 

The revised contents in the Review Guidelines include
一、To respect the food preferences of foreigners differing from those of local people, the control rights for food are secured for foreigners, who will be granted deciding rights for their food. Regardless of free provision or paid provision of food, employers shall consider foreigners’ preferences and pay attentions to sanitation, sufficiency, and equal-value for food. With foreign employees paying for their food and with fewer than 30 in population, the majority of foreigners’ preferences shall be considered to decide meal types; however, when foreign employees number more than 30, employers and employees shall co-organize the meal committee, with 2 thirds consisting of foreigners. 

二、A special-designated employee shall make inspections and records for sanitation and safety of kitchen and restaurant, enhancing environmental cleanliness not only for their feeding safety, but also for feeding comfort. 

三、As living security is the basic element for life, dormitories shall be issued with using permits and qualified with fire security to ensure foreigners’ lives, and provide 3.2 square meters of living space for each foreigner to guarantee each one reasonably sufficient space. 
四、Protecting foreigners’ privacies and gender equity兩性平等, employers shall provide separated spaces for foreigner employees of different gender. 

五、Life guidelines for foreigner employees shall be written in their native languages to make them aware of living environment, facilities, and radio or video programs in foreign languages for those lonely away from home countries and unfamiliar with working environments. 

六、To cater to foreigners’ rights, petition channels without barriers shall be provided for foreign employees by employers, and notes of petition channels, and toll-free petition lines of city of special municipality and county (city) governments and of Bureau of Employment and Occupational Training, shall be posted in clearly observed areas.

According to the Council, employers shall abide by the revised Management and Approval Regulations for the Employment of Foreign Nationals, filling out the Informing Form for Migration-in of Foreign Employees, within 3 days after immigration dates of the foreigner employees after Nov. 1st, 2006, to notify local governments to implement inspections of life management planning documents for the second-type foreign employees and to issue the certificate for receiving the Informing Form for Migration-in of Foreign Employees that the employees may hold along with other proofs to apply for employment permits. Local governments shall conduct inspections within 2 months after issuing the certificate according to foreign life management planning documents. 

The Informing Form for Migration-in of Foreign Employees and the certificate for receiving the Informing Form for Migration-in of Foreign Employees are declared on website of the Bureau for citizen’s references, and foreigner’s life management planning documents will also be posted on the website after Oct. 24th, 2006.
