The Guidelines for City of Special Municipality and County (city) Governments to Inspect the ...

To protect foreign employees (as the second-type foreign employees) as stipulated by Subparagraph 8 to Subparagraph 11 of Paragraph 1 of Article 46, Employment Service Act and prevent relationship being forced to close and repatriation, the Guidelines for City of Special Municipality and County (city) Governments to Inspect the Employment Relationship Close between Employers and Second-type Foreign Employees is enacted and planned to be promulgated in late October, becoming effective on Nov. 1st, 2006. 

The key contents include

一、For reluctantly terminating the contract between employer and second-type foreign employee, both shall sign the agreement to close the employment relationship, complete with signatures of both sides, and submitted in person or the agreement along with an Alien Resident Certificate posted by mail to the supervising office in city of special municipality or county (city) government the working place is located in within 10 working days before the termination date. 

二、The supervising office, once receiving the agreement, shall process the telephone interview or visit to inquire about the real intention in the location recorded on the agreement before the termination date, and provide the second-type foreign worker with the petition line to prevent forced agreements. 

三、The supervising office shall arbitrate any disagreements found during inspection according to the labor-management dispute resolution procedure 

四、The local supervising office shall reserve the duplicated certificate for future reference after issuing the certificate and send the certificate along with the duplicated copies of the agreement and the Alien Resident Certificate submitted by the employer, to the police office in the location where the second-type foreign worker stays, for reporting. 

五、After the certificate is issued, the employer (or the agent with authorization documents) can identify himself with personal ID to retrieve the original copy of the certificate in the local supervising office or request mailing of the certificate. 

六、Upon receiving the certificate, the employer can immediately arrange for departure of the second-type foreign worker, and apply for worker substitution with proof and other necessary documents after departure of the second-type foreign employee.
