In order to effectively promote safety and sanitation management of the title agency of public works and national or public enterprises, and enhance specific staff on labor safety and health in local governments, the Ministry of Labor held the meeting of the National-wide 233 Project for Disaster Mitigation in Working Place - Regulation and System Sub-team and reached the following consensuses: 1. For enhancing labor safety in public works, the organization regulations or organization chapters shall stipulate the organizations’ missions on planning, design, construction, quality control, progress control, and work receiving, applicable to the Labor Safety and Health Act, and to be established with labor safety management unit and personnel. 2. Labor safety units of national or public enterprises shall be strictly organized as the first-level division to prevent functions of labor safety being weakened 3. Supervising department of labor affairs in county (city) governments shall establish safety and health specific unit and personnel based on the number of laborers in municipalities to smoothly promote relevant policies According to the Ministry of Labor, deaths and injuries in significant occupational disasters in construction industry account for over 50% of all, and those occurring in public works number over 40%. While building investment businesses, construction industries, engineering consultants, and construction personnel in governments, and relevant engineering works, to the Labor Safety and Health Acts are applicable; workers in upstream planning, design, and supervision scopes under the same danger are excluded. The final decision is that relevant personnel in construction institutes (such as construction bureaus, departments, and divisions) shall be included in protections of the Labor Safety and Health Act, and those institutes shall establish specific units and personnel in charge of labor safety. In addition, some business institutes used to merge labor safety division with environmental protection and quality control divisions, in order to simplify administrative organization, and thus the labor safety functions are excluded, weakening or obstructing rescue efficiency.The typical example is that the public safety and environment protection department is led by the director of environmental protection background and affiliated with the public safety division, which will not smoothly promote relevant policies and businesses. The Ministry of Labor stresses that requiring national or public enterprises to establish an independent and specific unit in charge of labor safety, led by the first-level director and forbidding them from escaping from legal restrictions, will be the priority and the model for private enterprises will be set up. Labor safety and sanitation are the local self-government items stipulated in the Local Government Act, and disaster mitigation shall be completed with cooperation between countries for complicated safety issues and challenges; therefore, the meeting has discussed and passed the Guidelines for Setting up the Labor Safety and Sanitation Unit (Personnel) under the Administration Agency of Labor Affairs in County (City) Government to require local governments to adjust organizations and human resource contributions, provide innovations on disaster prevention assistance, promotion, and education and training, and cooperate with the central government for disaster mitigation. |
