Council of Labor Affairs indicated, employers who apply to hire foreign labors, will issue a two year hiring permission after the foreign labors arrive. When the period expires, and a continuous hiring is needed, the employer can apply again for an extended one year hiring permission. If the employers change the foreign labors within the two year period of hiring permission, they can apply again through recruitment (it needs to go through domestic recruitment procedures and the qualification examination.) There was a report saying employers hire foreign workers to work in Taiwan, and only granted one day hiring permission. It is because the employer could not only make up the original period of hiring permission, but also can extend the period of hiring permission to one more year. The case is granted with one day hiring permission and the employer was asked to apply for the extension. However, after two notices to the employer, he still has not applied for it. Therefore, Council of Labor Affairs notified the employer in accordance with the Law to change the employer for the foreign workers with a specific period of time或or arrange them to exit with the foreign worker’s approval. Council of Labor Affairs appealed to employers who change foreign workers within the 2 year hiring permission period that they should consider the application in details. If it belongs to make-up application, they should specify the hiring permission period before the foreign workers come to Taiwan. If it is the employer who made the foreign worker to change to another employer, the employer should try his best to assist. If there is any occurrence of violating the foreign worker’s willingness, or forcing the foreign worker to go back to his country, the Council of Labor Affairs will punish in accordance with the Laws. |
