Application and management of foreign workers in Taiwan

Foreign worker in Taiwan:

  1. Foreign worker management
    The foreign worker policy is comprehensively reviewed based on conclusions of Foreign Worker Policy Advisory Group meetings and under the principle of protecting the employment of R.O.C. citizens. Measures to strengthen foreign worker management and protect the rights and interests of foreign workers include reviewing current foreign worker management and broker management systems and laws; preventing foreign workers from becoming victims of human trafficking and strengthening related protection measures; implementing living care services for foreign workers and brokering visits at an expense; expanding the scope of work applicable for directly hiring foreign workers; strengthening management of brokers and implementing a reward and elimination mechanism for foreign worker brokers.
    Work permit application services for foreign workers are as follows:
    (1) Application method: Applications are separately submitted by item, and examination fee payment and delivery methods are provided.
    (2) Application procedures: A flowchart of application procedures is provided (from after an application is received at the service counter to when the employment permit is issued).
    (3) Application notices: Reminders to pay employment stability fees and salary of labor contracts may not be lower than the minimum wage.
    (4) Application form and required documents: Select the application form suitable for your industry, and prepare a list of the foreign workers, certificates, and letter of guarantee.
    (5) Employment stability fee: Stability fee payment record inquiry.
    (6) Application progress inquiry: Inquire about the progress of an application by employer number or received number.
    (7) Announcements: Provides the latest news, laws and regulations, application form revisions, and interpretations.

  2. Specialized foreign workers
    The main purpose for hiring specialized foreign workers is to utilize their specialized knowledge and skills to import advanced technologies and know-hows, which will elevate the technology levels of domestic industries and further enhance their competitiveness. For this reason, countries around the world are actively recruiting such workers. Taiwan began examining work permit applications for specialized foreign workers through the MOL's single window on January 15th, 2004. The MOL has suitably reviewed regulations on work permits for specialized foreign workers in coordination with domestic economic development, the employment market, and labor supply/demand in individual industries since then, so as to balance the employment rights of citizens with enterprises' demand on human resources.

    Work permit application services for specialized foreign workers are as follows:
    Work permit application services:
    (1) Application method: Applications are separately submitted by item, and examination fee payment and delivery methods are provided.
    (2) Application procedures: A flowchart of application procedures is provided.
    (3) Application notices: Reminder for employers or foreigners to fill in a "Statement to Personally Collect Documents" if they wish to personally collect documents. If it is necessary to extend the employment of foreign workers, an application must be submitted at least 4 months before the original employment permit expires.
