For any insured unit that employs no less than 50 employees, the industry-specific rate shall be determined under a merit rating system, where such a rate is calculated and adjusted annually based on the total insurance benefits paid for occupational accidents as a percentage of the total premium payable and the records of occupational safety and health in the most recent three years.
