Q8. Is an insured person still limited to claiming only one type of annuity after the Act came into effect?

  • Last updated:2022-06-14

Under the current labor insurance, any insured person who has met the criteria for multiple types of annuity for different insured accidents may claim only one of them, and his/her choice may affect how his/her employer offsets the responsibility of compensation for occupational accidents. Thus, Article 58 of the Act stipulates that any insured person who has met the criteria for benefits of the occupational accident insurance and other social insurance annuities simultaneously for different insured accidents may claim such benefits jointly and that the annuity of the occupational accident insurance will be adjusted down based on the principle of appropriate protection.
